Burgess, Jacob (b. ABT 1718, d. ?)
Note: A doubt exists whether this Jacob, who became "old Den.Jacob", of lamesborough, was the son of Jacob, or of Samuel. Jacob, sen., in his Will, makes no recognition of any child, but gave his property wholly to William. "a kinsman," who took the care of him and his wife in their old age. In answer, it may be said that no coach, car or mail, was then established between Lanesborough and Barnstable County; and, further, it may be presumed that his property was fully exhausted in his board and apparel to the advanced age of 92 years.

On the other hand, our Jacob is thrice called junior, in the record of his admission to the second Church in Yarmouth, in his marraige with Ruth Wood, and in his letter of transfer to the church in Middleborough. As we believe that "junior" was applied only to a son in the old Records second or third was used to designate one of the same name, this evidence is nearly conclusive.

Rounds be appointed Guardian of the ______ & Estates of Arnold Burgess and Lorry Burgess, minors under the ages of fourteen years, son and daughter of the late Welcome Burgess late of Foster dec--d & he accpts said appointment. ______ Bond with Nathan Wood and Simon Hopkins as surety. ----- ----- -----

Mary Burgess a Minor over the age of fourteen years, daughter of Jacob Burgess dec-d makes choice of Thomas Wood 2d as her Guardian -- whereupon it is Decided that our choice be and the same is hereby approved --- and said Thomas Wood 2d accepts of the Guardianship, Agrees Bond with Nathan Wood & Sampson Preston as surety.

An Instrument purporting to be the last Will & Testament of Jacob Burgess late of Foster dec-d is presented for Probate -- all persons intersted in therein being present in person _____ Guardian Acknowledge Notice and David Chase, James Crowninshield & Hos?_____ the three subscribing Witnesses to said Instrument declare on oath that they in the ____ of the of the said Jacob Burgess & of each other, saw the said Jacob Burgess sign or initial said instrument and heard him declare the same to be his last Will & Testament, & that at this time aforesaid appeared to be of good sound discerning mind & memory, & no person appears to oppose the Probate of said Instrument. It is therefore Decreed that said Instrument be allowed and approved as and for the last Will & Testament of of the said Jacob Burgess & that ____ Recorded --- And Leonard Burgess the Executor named in said late Will & Testament accepts of his appointment as Executor and gives Bonds with Hosea Martin as surety --- --- ---
Decreed -- that Simon Hopkins, Benoni Rounds, and Benjamin Hopkins be appointed to take an Inventory of the personnal Estate of Jacob Burgess dec-d and duly engaged Cyril Rounds Adm- on the Estate of Stephen Bennett dec-d on Oath presents an account in settlement of said Estate
