Will of Benjamin Kilgore Dated---March 22, 1802 - I BENJAMIN KILGORE of the state of Kentucky & county of Livingston being weak in body but of sound and perfect mind memory reason and understanding now calling to mind the mortality of my body and Knowing that its appointed of god for all flesh once to die do make ordain and declare this my last will and testament and desire it to be recieved by all as such first my body to the Earth from whence it was taken my soul to god who gave it. touching my worldly estate wherewith it has pleased god to bless me with in this life I will and positively order that it be dealt with and disposed in the manner following and herein after mentioned by those to whom I shall commit its future management I order that all my worldly debts be Justly paid out of my estate. then I leave to my son JAMES KILGORE two dollars as his full share of my estate and I also give to my daughter JANE ADAIR the like sum of two dollars as her full share of my estate to be their entire share and Legacy forever of my estate then I order that my son JONATHAN KILGORE be schooled so long as will enable him to read write and cypher well as far as the rule of three at the expence of my estate then I will and positively order that all and singulary every part and parcel of the remaining part of my estate together with my Lands Tenements and hereditaments be and remain in and for the proper possession use and support of my wife JANE KILGORE for and during her natural lifetime without any other distribution except such as may be necessary for then from and after the time of her death I will and positively order that the remaining part thereof be conducted in the manner following. I give to my son JONATHAN KILGORE one negro girl named JUDE aged about nine years old as also the plantation and tract of land whereon I now live containing two hundred acres which I also order to be cleared through the office at the expence of my estate and if he the said Jonathan should die before he marries or comes of lawful age then the Legacy left to be equally divided between ELIZABETH WOOD, ISABEL GREER, JOHN. WILLIAM, DAVID, HUGH, SAMUEL and POLLY KILGORE. then I also give to my son BENJAMIN KILGORE fifty dollars as his full share and Legacy out of my estate forever I also give to my son JOHN KILGORE one negro boy named GEORGE aged about two years old. I also give to my son DAVID one other negro boy named DANIEL aged about five years old. I also give to my son HUGH one negro woman named SYLVI aged about Twentysix years old. I also give to my son SAMUEL one negro man named DANIEL aged about twentynine years old. I also give to my daughter POLLY KILGORE one negro boy named PETER aged about two months old, the five last mentioned negroes if still alive at the death of my wife are to be valued by two or mor fit persons and the Legatees to whom I have left them are to recieve them at their valuation then all my other estate that may be yet remaining together with the increase of the negro woman left HUGH KILGORE if any there should be before the death of my wife I ordere to be sold in due form of law and the money arising therefrom to be equally divided between ELIZABETH WOOD, ISABEL GREER, and WILLIAM KILGORE. then the five Legatees to whoom I have left the five last mentioned negroes shall pay back or recieve as the case may be so as to make the Legatees all even and equal between ELIZABETH WOOD, ISABEL GREER, JOHN. DAVID. WILLIAM, HUGH, SAMUEL & POLLY KILGORE but if either of the last five mentioned negroes should die before the Legatees recieves it they shall yet command their equal share as before mentioned so as to have the same advantage as was before mentioned. BENJAMIN KILGORE - Was a revolutionary soldier who was among the early settlers of upper South Carolina, after the treaty of Governor Glenn with the Cherokee Indians in 1755. he had one son, James, who married Harriet Benson ( I believe this to be incorrect, on all information I have seen, James' wife was Keziah Greer, Harriet Benson was Josiah Kilgores wife, son of James Kilgore ) of Columbia, S. C, and had children as follows;Josiah Kilgore, who was a graduate of the Sout Carolina College; Jesse Kilgore, who moved to Kershaw County, SC; Dr. Benjamin Kilgore, who moved to North Mississippi; James Kilgore of Newberry, SC; Mary, wife of Colonel T. B. Brockman of Greenville, S. C, who became the mother of Mrs. Harriet Anderson, wife of Captain David Anderson; and Margaret and Malinda, both of whom married Barrys of Tyger River. Josiah Kilgore was the father of Dr. B. F. Kilgore, a sketch of whom we present herein; May, the wife of John Stokes, Esq.; Harriet, wife of Dr. Melmoth Hunter, of Laurens county, SC; Dr. William Kilgore and Clayton Kilgore. In the office of Secretary of State, Columbia, S. C, the following papers are on file, showing the public service rendered by Benjamin Kilgore during the Revolution. These papers were copied by Dr. B. F. Kilgore while a member of the House of Representatives, previous to 1860. "State of South Carolina, To Benjamin Kilgore Dr."1780, May 27th. To Captain's pay from March 6th, 1779, to this day in Colonel William's Regiment, 96 District, having been on duty the whole of that time as horsman, 432 days @@ 7 F. 1512." "September 27th. Left Pennsylvania in the 1760s and went to South Carolina. Went back to Kentucky in late life and died there. His wife Anna McCreary was killed when attacked by Indians; her son James survived. The "scalped babe" set a whole dynasty in the South in motion.

Kilgore, Oliver (b. ABT 1749, d. ?)
Note: Oliver owned a tract of land near West Pennsboro,Cumberland County PA which he is said to have sold to an ancestor of John Glenn on 7 April 1769. He was on a Tax List of 1779, 1781 and 1782 in Tyrone Twp, Perry County (once Cumberland Co.)PA On Dec 14, 1784 Oliver Kilgore sold for the sum of six pounds and one rifle gun valued at three pounds a tract of land. Oliver disappears with this 1784 land transaction from Perry Co PA He perhaps is sighted on a Harrison Co KY tax list which reads "Oloven" and Obed Kilgore perhaps a typo for "Oliver". His children and his wife and his place of residence after leaving Perry Co are unknown. He was mentioned in the will of his father James Kilgore in 1771 and in the will of his mother Elizabeth Jack Kilgore in 1782.

We find John's family in Franklin County OH on the 1807 tax roll and then in Madison County in 1810. They probably didn't move, but the border just changed. I find the Franklin County marriage records list Margaret Kilgore md Silas Springer 9/19/1809, with the consent of John and Jane Kilgore, meaning she was probably a minor. A Jenny Kilgore md Thomas Patterson 10/26/1809 (keep in mind Madison wasn't created until 1810). I am sure Jenny was really Jane because there is not marriage record for a Jane and Jenny was often a nickname for Jane. The John Kilgore family was the only Kilgore family in the county at the time, so there is no doubt that these two were John's daughters.

Here's how I fit them in this family:

I am reasonably sure the above are John and Jane's because they were the only Kilgores in Madison County during this timeframe. The 1820 census lists 2 males (16-25) living with Jane, John having already died. I believe one of them was John before he married in September, and I wonder if the other is a Charles who married Betsy Hunt 10/13/1831. None of her grandchildren would have been this old yet. The 1830 census shows a family living with Jane. Jane is not listed on the 1840 census. She was either living with Betsy at this time or had died.

The 1830 Franklin County census shows a Samuel Kilgour. I don't have a clue who he is or if he may even belong to John's family. But the Franklin County marriage records show three marriages in 1821, 1822, and 1826. Maybe these are Samuel's children or maybe more of John's, but I have not found a connection. However, I am not disputing it.

The 1883 History page 769 states the following about Elizabeth's (Betsy's) parents: John Kilgore, a native of Westmoreland County, PA, with his wife Jane and family emigrate to Ohio, and settle in Ross County in 1797; thence, about 1809 the removed to Madison County and settled on Three-Mile Run, about 1 1/2 miles west of Big Darby, where he died soon after. His wife subsequently moved to Union County, where she remained until her death at an advanced age. Page 770 - the following appears about Elizabeth (Betsy): Betsy married Judge Dodge, who died, and she is now a widow residing in Marysville, Union County, Ohio.

John Kilgore, a native of Westmoreland County, Penn. with his wife Jane and his family, emigrated to Ohio and settled in Ross County in 1797 : thence, about 1809, they removed to Madison County and settled on Three-'file Ruin, about one and a half miles west of Big Darby. where he died soon after. His wife subsequently moved to Union County. where she remained till her death at an advanced age. Their children were as follows : Thomas. who was eighteen years of age when they settled in Madison County. and here in 1812 he married Jane Patterson. who was born in Botetourt County. Va.. October 8, 1792, they settled on the place where his son Harvey now resides. and here remained till his death. February 11, 1872, aged eighty-one years. His wife died June 3, 1862. They bach eleven children, six now survive. Those deceased were William, Eliza, Rebecca, Sarah and Lucinda ; and those living are John. who married Maloney Beach : William. married Mary Boyd : Harvey. married Judith Sherwood ; Simeon, married Elizabeth Cary, and resides in Union County. Ohio; Elizabeth, married Chauncey Beach, and resides in Franklin County ; and Rebecca, married Jacob Taylor. Mr. Thomas Kilgore lived a long and useful life in Canaan Township, having at the time of his death. been a resident here over threescore years and on the same farm where he first settled. He was one of the true pioneers. and performed his full share in developing the country and bringing it from its primeval state to its present beautiful condition. He was a man of great moral worth and integrity of character. and had a great influence in molding the general character of the community, both politically and religiously, as during his life he held most of the offices of importance and trust in his township, and religiously had been a devoted member of the Methodist Church from his young manhood, or a period of sixty years. His example before his family and the community, was one worthy of admiration and imitation. And of his consort we may add, she possessed all the many virtues of kindness and religious devotion which rendered her a true helpmeet ; and their lives were a true blessing to their family and community, and have left behind them recollections of esteem and respect not soon to be forgotten. Of the other children of John Kilgore. James, married and moved to Missouri, where he
